Welcome to Hidden Harbor Designs.

These Terms of Service ("Terms") govern your access to and use of the Hidden Harbor Designs website, online store, products, and related services (collectively, the "Services").

The Services are provided by Johannes Baumgärtner, operating under the business name Hidden Harbor Designs ("Hidden Harbor Designs", "we", "us", or "our").

Our store is hosted by Shopify, which provides us with the online commerce platform that allows us to offer our products and services to you.

By accessing our website or purchasing products from us, you agree to these Terms and to the policies referenced in them. If you do not agree with these Terms, please do not use our Services.

1. GENERAL INFORMATION

Hidden Harbor Designs is an independent online shop offering art prints, posters, and other products featuring original designs and artwork.

Our products may be produced and fulfilled by third-party manufacturing and fulfillment partners on our behalf.

Nothing in these Terms limits any mandatory rights you may have under applicable consumer protection laws.

2. ELIGIBILITY AND USE OF OUR SERVICES

You may use our Services only if you are legally permitted to enter into a binding agreement in your country or jurisdiction.

If you provide information to us when placing an order or using our Services, you agree that the information you provide is accurate, complete, and current.

You are responsible for maintaining the confidentiality of any account credentials associated with your account and for activities carried out through your account.

We reserve the right to refuse or cancel orders where permitted by applicable law, including in cases of suspected fraud, unauthorized activity, pricing errors, or other circumstances that may reasonably require cancellation.

3. OUR PRODUCTS

We make reasonable efforts to display our products, artwork, colors, dimensions, and other product information as accurately as possible.

However, colors may appear differently depending on your monitor, display settings, device, lighting conditions, and other technical factors.

Product images may also contain lifestyle or mockup images intended to illustrate the appearance of a product. The actual product may vary slightly from images shown on the website.

Product specifications, designs, availability, and descriptions may be updated from time to time.

Because many of our products are produced to order, slight variations in printing, color, texture, positioning, or finish may occur and do not necessarily constitute a defect.

4. ARTWORK AND ORIGINAL DESIGNS

Unless otherwise stated, artwork, illustrations, graphics, photographs, logos, product designs, text, and other creative material displayed on our website are owned by or licensed to Hidden Harbor Designs.

Purchasing a product does not transfer ownership of the underlying artwork or any intellectual property rights to you.

You may use purchased products for your personal, non-commercial purposes.

You may not reproduce, copy, distribute, resell, modify, digitize, commercially exploit, or otherwise use our artwork or designs without our prior written permission.

5. ORDERS AND CONTRACT FORMATION

When you place an order through our store, you are submitting an offer to purchase the products in your order.

After you submit your order, you will receive an order confirmation by email. The order confirmation acknowledges that we have received your order; it does not necessarily constitute acceptance if we are unable to fulfill the order.

We reserve the right to cancel or refuse an order where permitted by applicable law, including where:

a product is unavailable;
there is an obvious pricing or product description error;
payment cannot be processed;
we reasonably suspect fraudulent or unauthorized activity; or
circumstances outside our reasonable control prevent fulfillment.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled order.

Please review your order carefully before completing your purchase. Because many of our products are made to order, cancellation requests may not be possible once production has started.

6. PRICES AND PAYMENT

All prices displayed in our store are shown in the currency indicated at checkout.

Unless otherwise stated, shipping costs, applicable taxes, customs duties, or import charges may be added at checkout or may otherwise be payable by the customer depending on the destination and applicable law.

The price applicable to your order is the price displayed at the time your order is placed.

We reserve the right to change prices, product offerings, discounts, and promotions at any time. Changes will not affect orders that have already been accepted, except where correction of an obvious error is required.

Payment must be successfully authorized before an order can be processed.

7. SHIPPING AND DELIVERY

We use third-party fulfillment and shipping partners to produce and deliver certain products.

Products may be manufactured and shipped from different fulfillment locations depending on the product, destination, availability, and fulfillment partner.

Estimated processing and delivery times are provided for informational purposes and may vary.

Shipping delays may occur due to circumstances outside our reasonable control, including carrier delays, severe weather, customs processing, strikes, transportation disruptions, incorrect shipping information, or other unforeseen events.

You are responsible for providing an accurate and complete delivery address.

If an order cannot be delivered because an incorrect or incomplete address was provided, additional shipping costs may apply if a replacement shipment is requested.

Where applicable, customers are responsible for customs duties, import taxes, or other charges imposed by the destination country unless expressly stated otherwise at checkout.

8. RETURNS, REFUNDS AND DAMAGED PRODUCTS

Our return and refund rules are described in our Return & Refund Policy, which forms part of these Terms.

Because many of our products are produced to order, we generally do not accept voluntary returns or exchanges solely because a customer changes their mind, selects the wrong size or color, or no longer wants the product, except where applicable law gives the customer a right to cancel or return the order.

If you receive a product that is damaged, defective, incorrectly produced, or different from what you ordered, please contact us as soon as reasonably possible with your order number and photographs showing the issue.

Depending on the circumstances, we may offer a replacement, refund, repair, or another remedy available under applicable law.

Nothing in these Terms or our Return & Refund Policy limits any mandatory statutory consumer rights.

For customers in the European Economic Area, statutory rights relating to withdrawal and conformity of goods apply where required by law. Further information is provided in our Withdrawal and Refund Policy.

9. RIGHT OF WITHDRAWAL FOR EEA CUSTOMERS

If you are a consumer located in the European Economic Area and your purchase is subject to a statutory right of withdrawal, you may have the right to withdraw from the purchase within 14 days without giving a reason, subject to applicable legal exceptions.

Certain products may be exempt from the statutory right of withdrawal where the legal requirements for an exemption are met, including certain goods made according to the consumer's specifications or clearly personalized goods.

Whether a particular product falls within a statutory exception depends on the applicable law and the specific circumstances of the order.

Nothing in these Terms is intended to exclude or restrict statutory withdrawal rights where they apply.

10. PRODUCT CONFORMITY AND STATUTORY RIGHTS

We are responsible for ensuring that products sold through our store comply with the mandatory statutory requirements applicable to the sale.

If a product is defective, does not conform to the contract, or otherwise fails to meet mandatory legal requirements, you may have statutory rights to remedies such as repair, replacement, price reduction, refund, or other remedies depending on the circumstances and applicable law.

These statutory rights are not limited by our voluntary return or refund policies.

11. USER REVIEWS AND FEEDBACK

If you submit a review, comment, photograph, suggestion, or other content to us ("User Content"), you represent that you have the necessary rights to submit that content and that it does not violate the rights of another person.

By submitting User Content, you grant Hidden Harbor Designs a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content for purposes related to operating, improving, and promoting our Services.

We may remove User Content where reasonably necessary, including where it is unlawful, misleading, abusive, offensive, or infringes the rights of another person.

We do not claim ownership of your User Content.

12. THIRD-PARTY SERVICES AND LINKS

Our Services may use or contain functionality provided by third parties, including Shopify, payment providers, fulfillment providers, shipping carriers, analytics providers, and other service providers.

We may also provide links to third-party websites.

Third-party services and websites are governed by their own terms and policies. We are not responsible for the content or policies of third-party websites that are outside our control.

Our use of third-party fulfillment services does not change the fact that your purchase from our store is a transaction with Hidden Harbor Designs.

13. INTELLECTUAL PROPERTY OF THIRD PARTIES

Our Services may contain names, logos, trademarks, or other intellectual property belonging to third parties.

Such material remains the property of its respective owner.

Nothing in these Terms grants you permission to use third-party intellectual property without the applicable owner's permission.

to commit fraud or facilitate fraudulent activity;

Nothing in these Terms excludes liability that cannot legally be excluded.

To the maximum extent permitted by applicable law, Hidden Harbor Designs shall not be liable for indirect or consequential losses that are not reasonably foreseeable at the time the contract was entered into.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

In particular, nothing in these Terms limits liability for:

death or personal injury caused by negligence where such limitation is prohibited;
intentional misconduct or fraud;
breaches of mandatory consumer rights;
statutory product liability; or
any other liability that cannot legally be excluded or limited.

18. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our Services, business practices, legal requirements, or other circumstances.

The most current version will be published on this page with the applicable update date.

Changes will apply from the date they become effective and will not retroactively alter rights relating to orders already placed where prohibited by law.

19. GOVERNING LAW

These Terms are governed by the laws of the Federal Republic of Germany, unless mandatory provisions of the law applicable to consumers in their country of residence provide otherwise.

If you are a consumer, you retain the protection of any mandatory consumer protection provisions that apply in your country of habitual residence.

Nothing in this section is intended to deprive consumers of rights that cannot legally be excluded.
